Introduction
These Terms and Conditions of Sale (the “Agreement”) apply to all orders placed via the Website salomonsports.co.za (the “Site”) between:
- Salomon Sports (Trail Terrain Sports cc), a South African company (VAT 4180 199 376), PO Box 47539, Greyville, 4023, South Africa, telephone +27 31 003 8898 (referred to as “We”, “Us”, “Our” or the “Vendor”), and
- You, the natural person residing in one of the territories listed below (referred to as “You”, “Your” or the “Customer”), purchasing goods and/or services via the Site strictly for personal use (not for commercial purposes, resale or transfer).
Together, We and You are the “Parties”. This Agreement governs our relationship in relation to any order you place via the Site. It replaces all earlier versions of our terms.
Should any matter not be expressly covered here, it will be governed by the customary rules applicable to distance selling companies based in France.
Article 1 – Scope, Applicable Law & Territories
1.1 Purpose This Agreement sets out the terms governing the sale of goods and services via the Site, including how you place, pay for, track and receive your orders, and any warranties or rights you may have under law. We may update this Agreement at any time, and the version in effect when you place your order will apply.
1.2 Applicable Law & Disputes This Agreement, the Site and all orders placed on it are governed by French law. Any disputes will be submitted to the courts located where the defendant resides or where the goods were delivered.
1.3 Territories Orders may only be placed by customers residing (for both billing and delivery) in the following territory: South Africa. Residents outside this territory may not validly place orders via the Site.
Article 2 – Orders
2.1 Customer’s Acceptance You must read and explicitly accept this Agreement before placing any order. You can print or save a copy of the Agreement and your order summary.
2.2 Vendor’s Acceptance We will accept your order only if you reside in the approved territory and the delivery address is within that territory. After you place an order, we will send you an acknowledgement email showing the total amount (including VAT) and delivery terms. Prices and availability are valid only while the items are visible and available on the Site. If goods become unavailable after your order, we’ll notify you by email and refund
any amount for unavailable items. If all items are unavailable, we will cancel the order and reimburse you. We are not liable to compensate you for unavailability.
Article 3 – Description of Goods & Applicable Prices
3.1 Description of Goods You can view the main characteristics of the goods before ordering. However, images, drawings and descriptions on the Site are indicative only and not contractually binding.
3.2 Prices By placing an order, you accept the prices and descriptions displayed. Prices are shown in South African Rands (R) and include VAT, but exclude shipping/delivery costs. We may change prices at any time, and pass on changes in taxes or levies. However, once your order is confirmed, we will charge you the prices and taxes displayed at that time, and will clearly show shipping/delivery costs in your shopping basket and at checkout.
3.3 Discounts & Promotions Any special offers, vouchers or discounts (“Discounts”) are valid only during their stated period and while stocks last. They are non-transferable, cannot be exchanged for cash and are applied only to the eligible order value (including tax but excluding shipping). Unless stated otherwise, you may not combine multiple Discounts in a single order — and if you have multiple, only the one giving the greatest discount may be used.
3.4 Sales Items Sale purchases made before the sale period will not be refunded just because the item later goes on sale. No refunds on sale items: they may only be credited as an online voucher. We reserve the right to vary, suspend, postpone or terminate any promotion without notice, and are not liable for technical issues or product unavailability.
3.5 Purchase Vouchers Any purchase vouchers issued to you may only be used by you and are subject to their specific terms (validity period, eligible goods, availability). They are non-transferable, cannot be combined with other vouchers or discounts unless stated, and cannot be redeemed for cash.
You must use the full value of a voucher in a single order. If the voucher value is less than the order value (excluding shipping), you must pay the difference plus shipping. If the voucher value is more than the order value, the order may be refused and you will be prompted to select more items. If the payment server prevents voucher use, it will be inactive for 72 hours, after which you may use it again.
Article 4 – Payment Terms
4.1 Currency Payments are made in South African Rands (R) for orders placed within the approved territory.
4.2 Payment Methods & Security Customers may pay online using Visa or Mastercard, providing card number, expiry date and the three-digit security code. When paying, you warrant you are authorised to use the payment method. Orders are subject to payment authorisation by the bank; if your bank rejects payment, the order will be cancelled. To prevent fraud, we may share order/payment details with a third-party verification service. We may request you to provide additional proof (e.g., address verification) if billing and delivery addresses
differ. Your account will only be debited when goods are dispatched. If some goods are unavailable, your account will be debited only for the dispatched items.
Article 5 – Delivery
For security reasons, your billing and delivery address must be in the same territory. Goods are delivered to the address you specify, and the delivery date is set as a maximum of 7 working days after order confirmation, depending on the delivery option and destination.
5.1 Delivery Terms We use courier services (e.g. Aramex) for deliveries in South Africa. Orders placed on a Friday, Saturday, Sunday or public holiday will be processed starting the next working day. Delivery times vary due to capacity.
5.2 Tracking Once your order is confirmed, you will receive a tracking number so you can monitor your parcel.
5.3 Receiving the Package The courier will attempt delivery to your personal address (including apartment floor) provided any access codes are given. You will be asked to sign a delivery note. If delivery fails (e.g., you’re absent, wrong address, inaccessible), the courier will record a non-delivery code and leave instructions for re-delivery or collection.
Article 6 – Warranties & Returns
6.1 General Except for goods personalised at your request, items sold via the Site may be exchanged or refunded under this Agreement and applicable law.
6.2 Return Terms If a product has a specific warranty, the terms and timeframe are detailed in its description. To return goods:
- Email us at customerservice@salomonsports.co.za to obtain a returns authorisation number.
- Returned goods must have been purchased on the Site, delivered to you, be in their original condition (not worn or washed), with original labels and packaging, and include the delivery note and returns authorisation number.
- Send goods to: Salomon Sports, 54 Brickworks Way, Briardene, Durban, KwaZulu-Natal, 4051, South Africa. You are responsible for return shipping. If the return is due to our error (e.g., wrong item shipped), we will reimburse shipping at the standard 2nd-class postal rate in South Africa. Once we receive the package, we will inspect the goods. If they don’t qualify for exchange or refund, we will not accept the return. You can collect the item from our warehouse or have it sent back to you (at your cost) within three months. If you fail to comply with return terms, you forfeit any claim for visible defects.
6.3 Exchanges Requests for exchanges must be submitted within 7 days of delivery and follow the same return process. After returning the item you no longer want, you must place a new order for the replacement item.
Article 7 – Liability
We are not liable for failure to fulfil our obligations under this Agreement if caused by force majeure as defined under South African law. We also disclaim liability for any inconvenience or damage arising from internet issues (site downtime, technical faults, viruses, data loss) or other indirect damages, whatever the cause.
Article 8 – Electronic Signature, Proof & Storage
When you submit your card details and finalise your order online, this constitutes your acceptance and liability to pay the full order amount. The Parties agree that any electronic data—such as website logs, order timestamps and digital communications—shall be admissible as valid evidence and shall carry the same legal weight as signed documents.
We will store all order forms and invoices on a durable medium, ensuring they remain intact. If you become aware of fraudulent use of your card, you should email our Customer Service immediately with your card number, order date and proof of identity. This does not entitle you to compensation from us, but you may claim from your card-issuing bank under applicable law and your agreement with the bank.
